Cancellation Policy

You can cancel your layby order at any time before you take delivery. This page explains when you get a full refund, when cancellation costs apply and how to cancel.

This policy forms part of your Layby Sale Agreement. Where anything here differs from your Terms of Sale, the Terms of Sale apply.

5 days Cooling off period from when you receive your agreement
30 days Cancellation period from the date of your order
$5 Dishonour fee each time a scheduled payment is missed

When you can cancel

You can cancel your order at any time before the latest of these:

  • the end of the cooling off period, which is 5 working days from when you receive a copy of your Layby Sale Agreement
  • the end of the cancellation period, which is 30 days from the date of your order
  • the point you take delivery of the goods

No goods are ever delivered before the cooling off period ends.

Cancelling within the cooling off or cancellation period

If you cancel during the cooling off period or the cancellation period, you receive a full refund of every payment made on that order. If any goods have already been delivered, return them to our office in the same condition you received them and we will refund the amounts paid on that order.

Cancelling after the cancellation period but before delivery

If you cancel after the 30 day cancellation period has passed but before the goods are delivered, you are refunded the payments made on that order less any cancellation costs.

Cancellation costs are our reasonable administration costs, being any dishonour fees on the account plus any delivery costs we have already incurred. There is no percentage charge and no fixed cancellation fee.

If the amount to be refunded is less than the cancellation costs, the agreement is cancelled and the remaining balance of the cancellation costs is payable to us as a debt.

Missed payments and dishonour fees

A dishonour fee of $5 applies each time a scheduled direct debit is missed, unless we have agreed to put that payment on hold. You can pause your payments for up to a total of 2 weeks by contacting us before the payment is due, and no dishonour fee applies for a payment placed on hold.

Your rights under New Zealand law

Nothing in this policy limits your rights to cancel under the Fair Trading Act 1986 or your rights in relation to the goods under the Consumer Guarantees Act 1993. If your agreement is an uninvited direct sale and we have not met the disclosure requirements in the Fair Trading Act, you may keep the right to cancel at any time.
