Privacy policy

This policy explains how Everest collects, uses, stores and shares your personal information when you visit our website, apply for a weekly payment plan, or buy from us.

We are a New Zealand business and we handle your information in line with the Privacy Act 2020.

Who we are

Everest is a trading name of Ashmont Group Limited, a New Zealand registered electronics and home goods retailer. We sell on layby with easy weekly payments. In this policy, "we", "us" and "our" mean Ashmont Group Limited. "You" means anyone who uses our website or buys from us.

Information we collect

Information you give us

When you apply for a weekly payment plan or place an order, we collect:

  • Your name, date of birth, and contact details
  • Your delivery address and billing address
  • Your New Zealand bank account details, so we can set up your direct debit
  • A copy of your New Zealand identification, such as a driver licence or passport
  • Details of the products you order
  • Any other information we ask for to help us verify your identity and assess your order

We ask for this because we need to confirm who you are, confirm you are 18 or over, confirm you live in New Zealand, and set up your weekly payments.

Information we collect automatically

When you visit our website we automatically collect technical information about your device and how you use the site. This includes your browser type, your IP address, your time zone, the pages you view, how long you spend on them, and how you arrived at our site.

We collect this using:

  • Cookies. Small data files stored on your device. You can disable cookies through your browser settings, though parts of our site may not work properly if you do. To learn more, visit allaboutcookies.org.
  • Log files. Records of actions on our site, including IP address, browser type, internet service provider, and dates and times.
  • Web beacons, tags and pixels. Electronic files that record how you move through our site.

How we use your information

We use the information you give us to:

  • Assess your application and set up your weekly payment plan
  • Verify your identity, age and New Zealand residency
  • Assess your ability to make the payments
  • Take your weekly payments by direct debit
  • Deliver your order and keep you updated on it
  • Provide customer support and respond to your questions
  • Detect and prevent fraud
  • Enforce our rights under your layby sale agreement if we need to
  • Meet our legal obligations

We use the technical information we collect automatically to keep our site secure, to fix problems, and to understand how people use the site so we can improve it.

Credit checks and assessment

When you sign a layby sale agreement with us, you authorise us to obtain a credit report about you and to share information with credit reference agencies. Please read this section before you sign.

To assess your ability to pay for your order and to verify the information you have given us, you authorise us to:

  • Obtain a credit report from a credit reporting service
  • Give our credit reference agency your positive credit information, including your repayment history, and information about any dishonour in your payment obligations
  • Make enquiries about fines with the Ministry of Justice, or using tools provided by the Ministry of Justice

We may also require you to provide information to a credit decision support service, such as Credit Sense. Where we do, you authorise that service to share your information, and their analysis of it, with us.

This authorisation is contained in the layby sale agreement you sign. You can read the full terms in our sales terms.

If you fall behind on payments

If you default on your payments, you authorise us to disclose personal information about you to your employer, to credit reporting agencies, and to debt collection agencies. We may also disclose information to any third party making an authorised enquiry about you.

We would always rather talk to you first. If something changes and you are having trouble paying, contact us on 09 928 6828 and we will discuss your options.

Who we share your information with

We share your information where we need to. That means:

  • Credit reporting agencies and credit reference agencies, as described above
  • Credit decision support services, such as Credit Sense
  • Payment providers, so your direct debit can be processed
  • Delivery partners, so your order reaches you
  • Debt collection agencies, if you default on your payments
  • Analytics providers, so we can understand how our site is used
  • Our agents and professional advisers, such as accountants and lawyers, where they need it to deliver their services to us
  • Other companies in our group, where we are offering you new products and services
  • Anyone we assign your agreement to, or who is considering taking a transfer of it, along with their professional advisers

We use Google Analytics to understand how visitors use our site. You can read how Google handles your information at policies.google.com/privacy, and you can opt out at tools.google.com/dlpage/gaoptout.

We may also disclose your information where the law requires it, such as in response to a court order, warrant, or other lawful request, or where we need to protect our legal rights.

We do not sell your personal information.

Storing and accessing information overseas

Some of our people and service providers are located outside New Zealand, including in the Philippines. This means your personal information may be stored, accessed or processed overseas when we run your payment plan, provide customer support, or operate and maintain our website.

Where your information is disclosed to or accessed from outside New Zealand, we take reasonable steps to make sure it is protected by safeguards comparable to those under the Privacy Act 2020, including through our agreements with those providers.

Marketing

We only send marketing emails to people who have asked for them or who have bought from us. Every marketing email includes an unsubscribe link. You can opt out at any time, and we will stop.

Opting out of marketing does not stop us sending you messages about your order or your payment plan, since we need to keep you informed about those.

If you receive an email you believe you did not ask for, forward it to info@everesttvs.co.nz and we will look into it.

Advertising

We may show you advertising on other platforms based on your visit to our site. You can opt out of personalised advertising:

  • Meta, covering Facebook and Instagram: facebook.com/settings
  • Google: myadcenter.google.com
  • Microsoft, covering Bing: account.microsoft.com/privacy/ad-settings

Do Not Track

Our site does not currently change how it collects or uses information in response to a Do Not Track signal from your browser.

How long we keep your information

We keep your information for as long as we need it to run your payment plan, meet our legal obligations, resolve disputes, and enforce our agreements.

Once we no longer need it, we securely delete or de-identify it. Some records, such as financial records, must be kept for a set period under New Zealand law.

Keeping your information safe

We take reasonable steps to protect your information from loss, misuse and unauthorised access. We keep your bank account details confidential and use them only as required to process direct debits. We keep your payment records confidential and disclose them only as required by law, or to an accountant, auditor or lawyer of ours who needs to know them.

No system is completely secure, so we cannot guarantee absolute security, but we take our responsibility here seriously.

Your rights

Under the Privacy Act 2020 you have the right to:

  • Ask what personal information we hold about you
  • Ask for a copy of it
  • Ask us to correct it if it is wrong

To make a request, contact us at info@everesttvs.co.nz, call 09 928 6828, or write to PO Box 11207, Ellerslie, Auckland 1542. We will respond within 20 working days. There is no charge for a standard request, though we may charge a reasonable fee if a request is unusually large or complex, and we will tell you before we do.

Complaints

If you are unhappy with how we have handled your information, contact us first at info@everesttvs.co.nz with "Complaint" in the subject line. We will acknowledge your complaint within 3 business days and respond within 14 business days.

If you are not satisfied with our response, you can complain to the Office of the Privacy Commissioner at privacy.org.nz or on 0800 803 909.

Children

Our services are for people aged 18 and over. We do not knowingly collect information from anyone under 18. If you believe a child has given us their information, contact us and we will delete it.

Changes to this policy

We may update this policy from time to time, for example if our practices change or the law changes. The date at the top of this page shows when it was last updated.
